INTRODUCTION

This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder. It is published in accordance with Rule 3 of the Information Technology (Intermediary Guidelines) Rules, 2011, which requires publishing the rules, regulations, privacy policy, and Terms of Use for access or usage of the marketplace e-commerce website and/or mobile application of Sahamithra Budget Friendly Store (hereinafter collectively referred to as the “Platform”).

This electronic record is generated by a computer system and does not require any physical or digital signatures.

The Platform is owned, operated, and managed by Sahamithra Budget Friendly Store Private Limited, a company duly incorporated under the Companies Act, 2013 (hereinafter referred to as the “Company”, “We”, “Us”, “Sahamithra”).

By accessing, visiting, or using the Platform, you acknowledge that you have read, understood, and agree to be lawfully bound by these Terms & Conditions (“Terms of Use”).
These Terms do not apply to third-party products or services, which are governed by their own respective terms.

TERMS

2.1 By accessing/using the Platform, you are deemed to have accepted these Terms of Use. We reserve the right, at our sole discretion, to modify or update these Terms from time to time.

2.2 “User”, “You”, or “Your” means any natural or legal person who accesses, browses, transacts, or avails any service on the Platform. By accepting these Terms, you also agree to be bound by our privacy policy, guidelines, rules, and other applicable policies as updated from time to time.

2.3 If You do not agree with these Terms, You are expressly prohibited from using the Platform and must discontinue its use immediately.

2.4 We do not permit children below the age of 18 years to use the Platform without the consent or supervision of a parent or guardian.

2.5 All donations made at the time of placing an order are non-refundable. Donations shall be disbursed to Give Foundation. Customer details may be shared with Give Foundation for issuing tax exemption receipts under applicable laws, complying with legal requirements, and performing charitable/social activities.
For tax receipts, users may contact Give Foundation at info@give.do.

USER REPRESENTATIONS

3.1 You represent and warrant that you are at least 18 years of age and are legally competent to contract under applicable law. Individuals below 18 may use the Platform only under parental/guardian supervision.

3.2 You must ensure that all registration details provided to the Platform are true, accurate, and complete. If We believe the information is incorrect or misleading, We reserve the right to suspend, block, or terminate your access.

3.3 You are solely responsible for maintaining the confidentiality of your account details and are liable for all activities conducted under your account. Sahamithra will not be responsible for any loss arising from unauthorized account usage.

3.4 You agree to use the Platform only for lawful purposes. You shall not attempt to decompile, reverse-engineer, hack, or disrupt any part of the Platform.

PERSONAL DATA

4.1 Your personal and sensitive personal data will be processed according to our Privacy Policy. Please review it carefully. By continuing to use the Platform, you consent to the collection, storage, processing, transfer, and sharing of your information as described in the Privacy Policy.

REPRESENTATION AND WARRANTIES

5.1 The Platform is provided on an “as-is” and “as-available” basis. You agree that your use of the Platform is at your sole risk. Sahamithra disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We shall not be liable for:

i. Any personal injury or property damage arising from use of the Platform or third-party seller products;
ii. Unauthorized access to personal/financial information stored on our servers;
iii. Any interruption or failure of transmission to/from the Platform;
iv. Any errors, omissions, or losses arising from use of content or services made available through the Platform.

We have implemented an appropriate grievance redressal mechanism and appointed a Grievance Officer who shall acknowledge complaints within 48 hours and resolve them within 1 month.

5.2 As a marketplace e-commerce entity, Sahamithra does not impose cancellation charges on consumers unless equivalent charges are borne by us or our sellers for unilateral cancellation.

5.3 We record customer consent for purchases strictly through explicit and affirmative user action.

5.4 Refunds will be processed within a reasonable timeframe or as prescribed by the Reserve Bank of India or applicable law.

5.5 As an e-commerce entity, we do not:
i. Manipulate product prices to gain unreasonable profit;
ii. Discriminate between Users of the same class or create arbitrary classifications.
